The instant petition is the third restoration petition which has been filed for restoration of a restoration petition bearing Cr. Misc. No. 41196/2017 which was filed for restoration of Cr. Misc. No. 32380/2017 and Cr. Misc. No. 32380/2017 was filed for restoring Cr. Appeal (SJ) No. 51/2017 which stood dismissed for non prosecution vide order dated 30.08.2017 and 19.07.2017 respectively.
Considering the submissions made on behalf of petitioner, Cr. Misc. No. 41196/2017 is directed to be restored to its original status, on account thereof, Cr. Misc. No. 55168/2017 is allowed.
