The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 409 of the Indian Penal Code.

The petitioner, who is Block Welfare Officer, was found missing without information as a result whereof inconvenience was caused in distribution of grains under the PDS scheme.

Submission is that this may be a case of disciplinary proceeding and no criminal liability is made out.
