Apprehending his arrest in connection with GO (Excise) Case No. 350 of 2017 arising out of Kamtaul P.S. Case No. 59 of 2017 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, the petitioner has filed the present application under Section 438 of the Code of Criminal Procedure for grant of pre-arrest bail.
After some arguments, learned counsel for the petitioner has sought leave to withdraw the present application in order to surrender before the court below and seek bail in the
