In this case, the petitioner is seeking anticipatory bail in connection with Majorganj P.S. Case No.59 of 2017, registered for the offence punishable under Sections 420 and 409/34 of the Indian Penal Code.

As per the F.I.R., misappropriation of fund has been made by Rajendra Kumar Jha, Incharge Headmaster of the school. The petitioner is the Clerk of the school.

Learned counsel for the petitioner submits that the order of the Sessions Judge itself discloses that he was not involved in misappropriation of the fund.

Looking to the aforesaid facts, let the petitionerNagendra Chaudhary @ Nagendda Chaudhary, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-I, Sitamarhi, in connection with Majorganj P.S. Case No.59 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
