Heard learned counsel for the petitioner and the State.

The petitioner apprehends his arrest in Rafiganj P.S. Case No. 26 of 2017 instituted for the offence under Section-307

& other minor sections of the Indian Penal Code.

Counsel for the petitioner submits that although the

injured received four injuries but out of those four injuries, three injuries were found to be simple in nature and one injury was found grievous. The same has not been found on vital parts of body of the injured.

As per written report, there is allegation against the petitioner that he assaulted the wife of the informant with iron rod indiscriminately by calling her Dayan on account of which, she sustained injury on her eye, chest etc. The daughter of the informant raised hulla. In the written report, the informant has

stated that he learnt from his daughter Sabita Kumari that this petitioner assaulted his wife with iron rod on several parts of body. The statement of Sabita Kumari has been recorded in paragraph-8 of the C.D. wherein she has supported the allegation, as levelled against this petitioner in the first information report. The statement of injured of this case, namely Dhan Kunwari Devi has been recorded at paragraph-3 of the C.D. She has levelled specific allegation against this petitioner of assaulting her indiscriminately with iron rod, fist, leg and slaps after calling her Dayan. The doctor found altogether four injuries; out of which, the doctor found one injury to be grievous in nature.

In this manner, the injury report supports the allegation that the petitioner gave repeated blow to the informant with iron rod, fist, slaps and legs.

This court, therefore, does not find it a fit case for grant of anticipatory bail. Accordingly, prayer for anticipatory bail of the petitioner stands rejected.

The petitioner is directed to surrender in the court below and seek regular bail.

The court below shall pass appropriate order in accordance with law without being prejudiced by order of this court after looking into the injury report of the injured, wherein
