3 06-07-2017 Heard learned counsel for the petitioners and learned APP representing the State.

Petitioners apprehend their arrest in connection with Derni P.S. Case No. 138 of 2016 registered for the offences punishable under Sections 147, 148, 149, 323, 353, 224, 225, 153 (A) of the Indian Penal Code.

Allegedly, the petitioners got freed Abhay Rai who was caught with 70 pouches (10 liters) of country made liquor and 15 liters country made liquor recovered from his house after attacking on the Police party and injuring some of the Police

Submission is of false implication and that no liquor was recovered, the informant has killed one of the family members of the petitioners and to put pressure this false case has been lodged, the injury received is simple in nature and as such the petitioners deserve sympathetic consideration.

Learned APP opposes the prayer of pre-arrest bail.

In the facts and circumstances stated above, considering that there is no specific allegation against the petitioners, the petitioners above named, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Derni P.S. Case No. 138 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
