3 01-07-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Jadopur P.S. Case No. 80 of 2016 registered for the offences punishable under Sections 414, 399 & 402 of the Indian Penal Code and Section 25(1-b)(a), 26, 35 of the Arms Act.

Allegedly, acting on a tip off that six persons with two motorcycle along with pistol and Katta are making plan to commit loot, raid was conduced but out of six, four were arrested and two succeeded in fleeing away and those four arrested persons stated the name of the petitioner and another co-accused, Rana Pratap Singh that they succeeded in fleeing away on motorcycle with pistol.

Submission is of false implication and that the petitioner

has been made victim of police atrocities. There is no legal and tangible material against the petitioner. The petitioner has never been apprehended with any firearm. No firearm has been recovered from the house of the petitioner and without any fault he is apprehending his arrest. The petitioner has been made accused in three more cases wherein he is on bail.

Learned A.P.P. opposes the prayer of pre-arrest bail and submits that the name of the petitioner was disclosed at once by other four co-accused.

In the facts and circumstances, stated above, considering that name of this petitioner has come in the confessional statement of the co-accused, as such, the petitioner, above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, is directed to be released on bail on execution of bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XIV, Gopalganj in connection with Jadopur P.S. Case No. 80 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
