2 25-05-2017 Heard learned counsel for the petitioner and learned APP representing the State.

The petitioner seeks bail in connection with Khaira P.S. Case No. 226 of 2016 registered for the offences punishable under Section 47 (a) of Bihar Excise (Amendment) Act, 2016.

Allegedly, from illegal manufacturing unit of the petitioner 45 tins each containing 15 liters straw liquor (Jawa Mahua), wooden logs and oven were recovered.

Submission is of false implication and that nothing has been recovered from conscious possession of the petitioner or from his house, he has been made victim of circumstances, without any fault the petitioner is suffering in custody since 06.02.2017 whereas similarly situated co-accused Ramesh Yadav and Manoj Yadav have already been allowed bail vide Cr. Misc. No.. 54461 of 2016, there is nothing to show that the petitioner

was preparing the country made liquor in the forest.

Learned APP fairly submits that two co-accused have been allowed bail.

In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 226 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
