7 09-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

The petitioner is the husband of the complainant/opposite party no. 2. There is allegation of demand of dowry and torture for the same. Notice was issued to the complainant but no one appears.

Submission of the petitioner is that the petitioner has stated on oath that the complainant has already married with one Santosh Mishra, hence, there is no scope for amicable settlement.

Considering the facts, let the petitioner, above named,

in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sadar, Sitamarhi/Successor Court in connection with Complaint Case No. C1-2180 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
