There were 205 petitioners initially before this Court, who jointly moved the High Court in CWJC No. 7767 of 2013, seeking a direction for regularization of their service against sanctioned vacant post of Trade Instructors in the respective trades in different Industrial Training Institutes situated across the State of Bihar.

The reason for seeking such a relief initially was that these petitioners came to be appointed on the post of Instructors on the basis of an advertisement issued on 12.8.2009, a copy of which is Annexre-2 to the writ application. After appointment, these petitioners have continued to work and now they are sought to be ousted on the ground that selection for candidates on substantive basis is going to be held and, therefore, they have to make way for such selected candidates.

The Court is not required to go into all other details of the disputes which have already been answered by this Bench earlier in the previous writ application, a copy of which is Annexure-13 to the present writ application. The matter is being re-heard because when the said order was challenged in an appeal, a Division Bench came to an opinion that the effect of Rule 3 (2) of Bihar Industrial Training Instructor Cadre Rules, 2013 was not taken into consideration by the learned Single Judge. The Division Bench, therefore, remanded the matter for reconsideration of the said legal aspect.

Since Rule 3(2) is the bone of contention, the Court reproduces the provision which reads as under:

“3. Cadre & Categories of Bihar Industrial Training Instructor.-

(1) Bihar Industrial Training Instructor cadre will be State level & its member will be the Instructor of Industrial Training Institutes situated in the State. The posts of the following categories will be in this cadre:-

(i) Trade Instructor, Drawing Instructor, Mathematics Instructor, Maintenance Instructor Electrical, Maintenance Instructor Mechanical, Stenography (Hindi) Instructor, Stenography (English) Instructor. All posts mentioned above shall be original cadre posts.

(ii) Chief Instructor/ Technical Assistant (First stage of promotion).

(iii) Assistant Superintendent (Second stage of promotion).

(2) The persons appointed and working in different category of cadre, shall be deemed to be automatically included in this

When the matter is taken up learned senior counsel representing

the petitioner argues that the appointment of the petitioners was against the vacant sanctioned posts and these are substantive posts. Their engagement could be on contract but right has been created because of the vacancy or existence of substantive posts.

This Court will not get into the argument on this aspect of the matter keeping in view the direction of the Division Bench but only to set the records in order, the Court would like to record that the advertisement itself clearly laid down as to the status of these petitioners at the time of their engagement. It was a stop-gap arrangement to ensure that the interest of the students did not suffer due to large number of existing vacancies subsisting in the various I.T.Is. and till substantive appointments were made they were required to continue. There are one to many documents on record including annexures 5 and 5/1, which in no uncertain terms told the candidates so selected and appointed as

to where they stood. It was a contractual appointment which was liable for termination the moment recommendations were made for permanent appointment after following the procedure by the Staff Selection Commission.

Therefore, the petitioners cannot urge and argue over and above the terms and conditions of their engagement. In fact, they will be debarred and estopped from urging anything contrary to the conditions indicated in the appointment letters. The terms of engagement were accepted by them with open eyes.

Coming to the effect of Rule 3(2) of the Industrial Training Instructor Cadre Rules, 2013, submission of the learned senior counsel is that in terms of Clause (2) of Rule 3 these petitioners were appointed and they were working in different category of the cadre. Therefore, by a deeming fiction they will be automatically treated to be included in the cadre and their continuance therefore by virtue of the provision of the said Rule is automatic. There is no occasion for them now to go through the rigors of examination and selection process and they cannot be ousted.

The advertisement against which the selection was made was issued in the year 2009. The Rule in question was notified on 19^th July, 2013. When the Rule talks of the persons appointed and working in different category of cadre, they are meant for substantively appointed persons. It is only those category of working persons who were supposed to be automatically included in the cadre. The engagement of the petitioners was as stop-gap arrangement as is the stand of the State counsel in this regard and not a substantive appointment.

Learned counsel representing the State also draws the attention of this Court to other provisions of the same said rules which are enumerated from Rule 5 till 14 and emphasis is placed on Rule 10. If the said provisions are read in

their entirety, it is absolutely clear that only such candidates who are selected and appointed by following the procedure and who fulfill the requirements, in terms of eligibility, qualification etc. can be treated to have been borne on the cadre.

Petitioners do not come in that category. The expression ‘appointed and working’, therefore, cannot be diluted and read down to mean even temporarily engaged candidates on contract to which category these petitioners belong. Therefore, no substantive right has been created in favour of these petitioners by virtue of the nature of their engagement and terms and conditions of the engagement on a reading of Rule 3(2) of 2013 Rules.

The Court, therefore, is in agreement with the stand of the State that the petitioners do not come in the definition or interpretation of ‘appointed and working’. The case of the petitioners was not a case of appointment but a case of engagement. Therefore, even this argument is repelled. The question is answered against the petitioners, in the sense that Rule 3(2) of the Bihar Industrial Training Instructor Cadre Rules, 2013 does not cover the case of these petitioners.
