This case is based on the complaint petition with allegation that the petitioner and other co-accused in collusion and conspiracy have created a sale deed wherein the petitioner and coaccused Dharmendra Kumar and Sunita Devi have executed the deed in favour of Jitwahan Kumar.

Submission is of false implication and that no offence as alleged is made out, other co-accused namely, Jitwahan Kumar, Dharmendra Kumar Singh have already been allowed bail by

another co-ordinate Benches of this Court and the petitioner is suffering in custody since 07.12.2015 as such the petitioner also deserves sympathetic consideration to which learned APP is not in a position to distinguish the case of the petitioner from that of coaccused.

In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Saurav Kumar Verma, J. M. Ist Class, Patna in connection with Complaint Case No. 61 ( c) of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
