2 20-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

During course of investigation of Laheriasarai P.S. case no. 220 of 2016, petitioner was apprehended and on his inculpatory extra-judicial confessional statement, stolen articles along with tempo used for theft were recovered. Furthermore, petitioner also disclosed that they made frequent visit during course of commission of crime through an auto-ricksaw which they have snatched near Rahika of Madhubani district. The police also traced out the relevant case bearing Rahika P.S. case no. 47 of 2016 filed relating to snatch of aforesaid tempo. So, instead of registering a different case, the seized autor-ricksaw should have been tagged with the aforesaid case with further addition of

Section 411 of 412 of the Indian Penal Code whichever may be. Furthermore, it is apparent that petitioner happens to be under custody since 15.06.2016. From para 3 of the bail petition, it is apparent that petitioner has got checkered history but in the facts and circumstances of the case, petitioner Md. Reyaz @ Surya is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. case no. 257 of 2016.
