02 17-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
Informant, A.S.I. had alleged that one Scorpio Jeep being escorted by motorcycle ridden persons was signalled to stop whereupon the occupants began to flee. Two persons were apprehended during course of chase. The person, who was occupying motorcycle had disclosed his name as Ashish Kumar Singh, the petitioner while the other being occupant of Scorpio, disclosed his identity as Saroj Kumar Sharma. It has further been disclosed that petitioner had disclosed name of his accomplice as Manoj Sarkar while Saroj Kumar Sharma had disclosed the name of co-accused Arvind Yadav. On search, nothing was found from
the motorcycle while from Scorpio, 242 litres of whisky was

seized. Petitioner happens to be under custody since 23.07.2016 and as per Para-3 of the petition, petitioner has got no criminal antecedent.
Accordingly, petitioner Ashish Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Purnia in connection with Baisi P. S. Case no.113 of 2016.
