JUSTICE RAKESH KUMAR ORAL ORDER 7 20-06-2016 At the very outset, Sri Vindhkeshri Kumar, learned senior counsel, who was assisted by Sri Nawal Kishore Singh, learned counsel for the petitioner, submits that though the present petition was filed for quashing of an order dated 16.11.2012 passed by the learned S.D.J.M., Danapur who declined to discharge the petitioner, by the same order the learned Magistrate has declined to transfer the case from the court of S.D.J.M., Danapur to proper jurisdiction.

well as Sri Kumar Alok, learned counsel for the informant / opposite party no. 2 makes a prayer for allowing the petitioner to withdraw the petition so that, petitioner may file appropriate petition before appropriate authority. He submits that order of rejection of discharge petition may not be interfered with, but he takes a plea that on the ground of territorial jurisdiction petitioner may take appropriate step. Accordingly, he makes a prayer for withdrawal of the present petition.
The prayer is allowed.
The petition stands dismissed as withdrawn.
