Petitioner is named in the first information report which has been lodged on the basis of fardbeyan of victim/informant. Moreover, according to the victim, three persons, namely, Umesh, Kamlesh and Rajiv were arrested by the police at the time of his recovery. Submission on behalf of the petitioner is that aforesaid three co-accused, namely, Umesh, Kamlesh and Rajiv have already been granted privilege of bail by different Benches of this Court whereas petitioner is in jail custody since11.08.2015 and except the present case as well as Khajauli P.S.Case No. 41 of 2011, petitioner does not have any criminal antecedent.
