2 25-04-2016 Heard learned counsels for the petitioner and the State. The petitioner, being the husband of the informant, is languishing in jail since 12.03.2016 in a case registered for the offences punishable under Sections 498A/341/323 of the Indian Penal Code and Section ¾ of the Dowry Prohibition Act.

The prosecution case, in short, is that the marriage of the informant was solemnized with petitioner in the year 2013 and for non-supply of an Alto Car as dowry, she was mentally and physically tortured. After one year of her marriage, the informant was driven out from her matrimonial home after subjected to assault on account of non-fulfilment of dowry demand.

Learned counsel for the petitioner submits that there is a general and omnibus accusation against all the in-laws’ family. It is further submitted that the investigation has already concluded and a statement has been made in paragraph No.8 of the petition

that there is nothing on the record to suggest that the informant was subjected to assault or had received any injury.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M-III, Gopalganj in connection with Baikunthpur P.S. Case No.26 of 2016.
