Petitioners apprehend their arrest in connection with Anti P.S. Case No. 46 of 2015 registered for the offence under Sections-307, 379 & other minor sections of the Indian Penal Code.
It is contended that there is case and counter case between the parties and both parties sustained injuries. All the injuries have been found to be simple in nature. It is contended that the altercation took place due to trivial dispute which emerged on the point of offering prayer in the mosque. Petitioners claim that they are having no criminal antecedent.
Having regard to the facts and circumstances of the case as well as submission of the parties, the petitioner Nos. 1, 2, 5, 6, 8, 9,10, 11, 12, 13, 14 & 15 named above, in the event of their arrest or surrender in the court below within four weeks shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Anti P.S. Case No. 46 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Gaya subject to conditions as laid down u/S 438(2) of the Cr. P.C.
