Petitioner apprehends his arrest in connection with Complaint Case No. 732 of 2015 for the offences punishable under Sections 406, 417, 420 of the Indian Penal Code.

The allegation as made in the complaint case is that the petitioner by way of criminal conspiracy sold out the land of the complainant, which the father of the complainant had acquired through execution of registered sale deed. It is further alleged that the petitioner along with others taking the Government machinery in their collusion, got rent receipt of the land issued in their favour and grabbed the land of the complainant.

It has been submitted by the learned counsel for the petitioner that the co-accused Anandi Singh and Sindhu Devi had executed a sale deed in favour of the petitioner. He being the purchaser was not involved as he has not purchased the land from the complainant. It has further been submitted that the matter relates to civil dispute and the petitioner has no criminal antecedent as evident in para 3 of this petition.

However, the learned APP for the State submits that petitioner is named in the Complaint case hence, opposes the prayer for bail.

Be that as it may, since the matter is a civil dispute, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of eight weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Katihar in connection with Complaint Case No. 732 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
