The application seeks modification in the order date 09.07.2015 passed in Cr. Misc. No.22188 of 2015 whereby the privilege of anticipatory bail was granted to the petitioner subject to deposit of 15 % defalcated amount at the time of furnishing of the bail bonds and another 10% of the defalcated amount within six months.

It is stated that the petitioner furnished the bail bond and further deposited 15% of the defalcated amount. However, he has difficulty in depositing the remaining 10% of the defalcated amount for the reasons stated in the application. It is, therefore, submitted that the time may appropriately be extended for

depositing the said 10% of the defalcated amount. The application was filed well before the expiry of time granted for deposit of the said instalment.

Having heard the counsel for the petitioner and the Corporation, the application is allowed the order dated 09.07.2015 passed in Criminal Miscellaneous No. 22188 of 2015 in connection with Kudra P.S. Case No. 100 of 2015 pending in the court of CJM, Kaimur at Bhabhua, is modified to the extent that, in place of six months, as noted in the last para of the said order, it shall be read as 09 months.
