3 11.05.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code.

Earlier prayer for bail of the petitioner was rejected by this court vide order dated 25.6.2015 passed in Cr. Misc. no. 13596/2015 and a very elaborate argument is advanced on behalf of the petitioner to show his false implication in the present crime as well as his innocence.

I am not at all convinced with the submissions of the learned counsel appearing for the petitioner.

The trial of the petitioner has already commenced and up till now, three prosecution witnesses have already been examined and, therefore, I do not feel it proper to enlarge the petitioner on bail, at least, at this stage. Hence, his prayer for bail in connection with Saharsa P.S. case no.316/2009 corresponding to Sessions Trial no.
