4 13-08-2015 Heard Mr. Akhauri Vipin Bihari Srivastava in support of the application.
This writ application is directed against the order dated 19.11.2009 passed by the Appellate Court in Title Appeal No. 35 of 2006/10 of 2009 whereby the Court has refused to formally amend the written statement said to have been filed by the petitioners. It is submitted that like the petitioners, defendant nos. 16, 17 and 18 also prayed for such amendment which was refused against which a writ petition being C.W.J.C. No. 2821 of 2011 was filed, which was dismissed on 9.5.2011 observing that the writ petitioner shall be entitled to make submission during the course of argument which the Court may consider after hearing the parties. He has sought permission of the Court to withdraw the application in the light of the said order passed in C.W.J.C. No. 2821 of 2011 (Hari Shankar Singh and Ors versus Shiv Shankar Singh and Ors.)
The writ application is permitted to be withdrawn.
