of Geeta Devi (supra) but considering the peculiar circumstances existing in the present case, this Court is not persuaded to go with the petitioner. The order of the Division Bench in appeal is dated 23.12.2013 and is placed at Annexure-12. The decision of the requisitionists is placed at Annexure-13 and is dated 28.12.2013 fixing the date of special meeting on 9.1.2014. The notice circulated by the Executive Officer communicating the date of special meeting on 9.1.2014 is dated 30.12.2013 and is placed at Annexure-14. Considering the time available with the petitioner either to discharge her obligation or to lodge her objection to the steps taken by the requisitionists, she cannot take refuge on her absence from the station. What this Court finds from Annexure-17 which is a copy of the ticket is, that whereas the petitioner booked her ticket on 27.12.2013, the date of journey is 3.1.2014 i.e. 10 days after the pronouncement made by the Division Bench and much after the decision taken by the requisitionists on 28.12.2013 as well as the notice circulated on 30.12.2013. The petitioner thus had ample time either to fix the date of special meeting or at least to raise her protest against the decision of the requisitionists. She did neither rather she avoided to face the no confidence motion by moving out of station. In any other circumstance, the hurry shown by the requisitionists in fixing the date of special meeting, would have persuaded this Court to accept the submission of learned
