JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 3 04-12-2015 The petitioner is party to Section 144 Cr.P.C. proceeding initiated by the Sub-Divisional Magistrate on 14.11.2011 The petitioner, aggrieved by the order passed by the Sub-Divisional Magistrate, filed a Cr. Revision application before the learned Sessions Judge, Nalanda at Biharsharif vide Cr. Revision no. 322 of 2011. The same was disposed of on 28.2.2012 noticing that the proceeding has outlived its life and the application has become infructuous. In the meantime, the respondents auction sold the crop which was harvested on the subject land and the proceeds thereof has been deposited. In my view, instead of challenging the order the SubDivisional Magistrate passed, the ends of justice shall be subserved if the petitioner is granted liberty to approach the Sub-
