The petitioners apprehend their arrest in a case under Sections 341, 323, 324, 504, 506 and 307/34 of the Indian Penal Code.

The allegation is that the petitioners assaulted informant’s sons Sudhir Yadav, Shailendra Yadav and his wife Janti Devi by lathi, rod and Khanti.

The petitioners submits that there is case and counter case bearing Barahat P.S. case no. 59 of 2015 lodged by Arun Yadav, in which the petitioner Chunnu Yadav and one Sanju Devi too sustained injuries. The petitioners thus submit that there was free fight between the parties over the land dispute.

It appears that both sides suffered grievous injuries. In my view, the grounds taken by the petitioners would be a good ground for regular bail. So far as anticipatory bail of the petitioners is concerned, I am not inclined to grant anticipatory bail to the petitioners. Their prayer for grant of anticipatory bail is rejected. However, if the petitioners surrender before the court below within four weeks from today and pray for regular bail the same would be disposed of on the same day without being prejudiced by this order.

With the aforesaid observations, this application stands disposed of.
