In this case, petitioner is seeking bail in Dehri-onsone Rail P.S.Case No. 17 of 2014 registered u/s 3 of RP(UP) Act. Allegation has been made that 50 Kg. of fertilizer was recovered from the possession of petitioner. He is in custody since 19th October 2014 having no criminal antecedent.

In the facts and circumstances of the case, petitioner Kishore Tiwary @ Kishor Tiwary is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Railway Magistrate, Gaya in connection with Dehri-onsone Rail P.S.Case No. 17 of 2014, subject to the condition that

the petitioner would co-operate in the proceeding of the court and if the petitioner will fail to co-operate and will remain absent for two consecutive dates without reasonable explanation, the court will pass appropriate order, including cancellation of bail bonds.
