The Circle Officer of block Sadar, Aurangabad is the informant of the case. Allegedly, some persons had blocked the road protesting against damage of an idol. In order to clear the road, the local administration appears to have intervened which resulted into some scuffle between the personnel of the district administration and the persons protesting. It is alleged that the mob abused the informant and assaulted him by Lathi and Danda, which was led of petitioner No. 5 of Cr. Misc. No. 48067/ 2014.

Learned counsel for the petitioners appears to be right in her submission that there is no motive against the petitioners of alleged commission of offence, as alleged. She further submits that there is no specific allegation against the petitioners of assault resulting into injury.

In view of submissions, as above, the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town PS case No. 310/2014, subject to conditions as laid down u/s 438(2) of the Code of Criminal Procedure
