2 03-11-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State.

This application for grant of regular bail arises out of Bochaha P.S. Case No.120 of 2015, disclosing offences under Section 393 of the Indian Penal Code.

As per the allegation, the informant was travelling in an auto-rickshaw, in which, two persons were already sitting. They are said to have attempted to snatch the money, which the informant had. The police in the meanwhile intercepted and the petitioner came to be

arrested.

Learned counsel, appearing on behalf of the petitioner, submits that he has no criminal antecedent and has been falsely implicated in this case, there being dispute over payment of fare. He further submits that petitioner is in custody since 14.07.2015.

Considering the submission, as above, and the fact that the petitioner is in custody since 14.07.2015, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
