Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 135 of the Electricity Act.

The accusation is of running welding machine by consuming electricity energy unauthorizedly when the total amount has been calculated to the tune of Rs. 5,47,683/-.

It is submitted by learned counsel for the petitioner that seizure is only few meters of wire when no welding machine has been seized. The petitioner is blind since long and during investigation, it transpired that welding machine was purchased on 11.11.2013 when the inspection was made on 11.12.2013.

petitioner was found consuming electricity unauthorizedly but does not dispute the fact that petitioner is blind person.

On deposit of Rs. 50,000/- before the concerned authority by the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Special Court, Electricity, Gaya in connection with Wazirganj P.S. Case No. 562 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
