Petitioners seek bail in a case registered under section 3027 and other allied sections of the Indian Penal Code. As per the first information report due to child dispute on 15.04.2015 at about 11.30 A.M. all the 14 named accused persons armed with various weapons came at the door of the informant and started abusing. became unconscious. Informant and his men came there and took the Rajbanshi Yadav to Primary Health Center where he was declared dead.
On behalf of the petitioners it is submitted that petitioners are in custody since 22.04.2015. The petitioners have no criminal antecedent. It is further submitted that there is no specific allegation made against the petitioners. The main allegation of assault is against Birbal Yadav.
On behalf of the State and the informant it is submitted that petitioners are named in the first information report. Considering eh aforesaid facts, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/ (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran at Bettiah in Majhauliya P.S. Case No. 159 of 2015.
