The prosecution case is that the informant was informed on 07.02.2015 by labour of the brick klin that firing has been resorted on his brick klin. The informant immediately rushed to the brick klin and found the office of the brick klin was burnt and chaukidar Surendra Singh lying dead. The motive for the occurrence is alleged to be the extortion demand through mobile. The name of the petitioner transpired in confession of the co-accused.

It is submitted by learned counsel for the petitioner that the investigating agency failed to investigate the two mobile numbers given in the F.I.R through which extortion

demand was made. Admittedly there is no eye witness to the occurrence and co-accused Laxman Singh @ Ajay Singh has been granted bail vide Cr. Misc. No. 23997 of 2015.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sikarahana at Motihari, East Champaran in connection with Phenhara P.S. Case No. 12 of 2014.
