Being aggrieved, on account of having been complained by the deceased, Satyendra Singh, it has been alleged that petitioner along with Bikram Singh, Balram Singh and Gulabi Devi threw brick particles from their roof over his house. When the members of prosecution party came out from their house, all the accused persons armed with Lathi, Danda and brick particles came and assaulted Satyendra Singh. When informant Ranjit Singh came in his rescue, he was also assaulted. While Satyendra Singh was lying on the earth, Suryadeo came with brick and assaulted over his face and temporal region and on account thereof, it has been said that Satyendra Sing died during course of treatment at Dihri.

From plain reading of the Fard-e-beyan as well as going through the order impugned, it is apparent that there happens to be omnibus allegation and that being so, petitioner, Madheshwar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in Khudwan PS Case No. 35 of 2014.
