the present occurrence, Shyam Bihari Singh was killed and in that case Alauddin Mian, Mustaquim Mian, Jiwabodhan Singh Yadav, Lalan Yadav, Lal Muni Yadav, Kalyan Yadav and others were made accused. In the same paragraph, he has also stated that he is not aware that in the same case Munna Singh and Ram Kumar Singh are the witnesses. In the same paragraph, he is not aware that Alauddin has gone to jail in the said case. In paragraph 15, informant admitted that in the counter case filed by Munna Singh, deceased Kalim Mian, Rahim Mian (P.W. 6), Fakira Mian, Alauddin Mian and Mustaquim Mian were made accused. In the same paragraph he, further volunteered that at the time of the said occurrence Mustaquim Mian was in the jail custody. In paragraph 16, P.W. 1 admitted that he was not aware from before that on the date of occurrence Kalim Mian will go to uproot the ‘Jalkumbhi’. Rahim Mian was just taking stroll at the time, place of occurrence and informant and others had no inkling that any occurrence is about to take place. In the same paragraph, informant further admitted that from the place of occurrence, he was at a distance of 2-3 bamboo. At the place where Kalim Mian was uprooting ‘Jalkumbhi’, Munna Singh and others came and asked him not to uproot the ‘Jalkumbhi’. There was no likelihood of firing being resorted but because of altercation, firing was made.
