and the year 1992. The petitioner defaulted in making repayment of loan. On 26.8.1994, a notice was issued to the writ petitioner under Section 29 read with Section 30 of the State Financial Corporation Act, 1951, informing the writ petitioner that if the writ petitioner failed to deposit the Corporation’s dues within 15 days from the date of service of notice, the latter would be at liberty to take over the mortgaged property and advertise the same for sale. The writ petitioner was also informed by a letter, dated 19.10.1994, that the dues of the Corporation had gone up to Rs.10.98 lacs as on 31.3.1994. By the said letter, one more opportunity was granted to the writ petitionerappellant to make payment of the outstanding dues within ten days failing which the mortgaged assets would be taken over under Section 29 of the State Financial Corporation Act, 1951. Eventually, the industrial unit was put to auction. However, no tender was received.
