aforesaid order dated 03.02.1984 in which sons of Raj Ballam were impleaded as respondents and after appearing in the writ petition and filing counter affidavit, three of them left for heavenly abode in 1984, 1988, 1994 and without substituting the three respondents the writ petition was allowed. The order disposing of the writ petition dated 25.09.1996 is a nullity. It is further submitted that after initiation of consolidation proceeding and death of Sheo Prasad, Dhanwanti united with sons of Raj Ballam i.e., Padum, Baijnath, Raghubans and Jagdish. While living with the heirs of Raj Ballam i.e., Padum, Baijnath, Raghubans and Jagdish, she left for heavenly abode on 26.02.1975. The lands inherited by Dhanwanti after her departure devolved upon sons of Raj Ballam i.e., Padum, Baijnath, Raghubans and Jagdish. After initiation of consolidation proceeding, Padum, Baijnath, Raghubans and Jagdish approached the Consolidation Officer for opening the khata with regard to the lands in question in their name. Consolidation officer passed order dated 15.11.1975, two years later heirs of Manraj and Fauzdar approached the Consolidation Officer in Case No. 266 of 1977 requesting him to correct the khata with regard to the lands in question in their name but such request was rejected under order dated 30.12.1976 against which Consolidation Appeal Nos. 257, 261 of 1977-78 were filed by the writ petitioner/contesting respondent in the two Appeals.
