We notice that L.P.A. No. 864 of 2008 was disposed of by judgment and order, dated 22.09.2008, after hearing the learned counsel, who has filed this M.J.C. application seeking restoration of the dismissal of the appeal so far as the respondent No.2 is concerned. Because of what has been pointed out above, we are of the view that as a result of the disposal of the appeal, this restoration application has become infructuous and shall stand disposed of accordingly.
