This application seeks restoration of CWJC No. 23160 of 2011 which stood dismissed for non compliance of the order dated 08.02.2012 whereby the petitioner was granted two weeks peremptory time to file supplementary affidavit. The time so granted expired on 22.02.2012.

Learned counsel for the petitioner submits that the supplementary affidavit was filed on 23.02.2012. The records of the writ case support the aforesaid contention of the petitioner. The delay of one day in filing supplementary affidavit has been explained in the application seeking restoration.

in support thereof, this Court modifies the order dated 08.02.2012 to the effect that the time granted thereunder shall stand extended to 23.02.2012 subject to deposit of cost of Rs. 200/- with the Patna High Court Legal Service Committee and filing receipt thereof within seven days.
