Petitioner has raised a grievance that his application seeking measurement of his land vis-à-vis the land belonging to the State of Bihar (Kaishar Hind) filed before the respondent Circle Officer, Keshariya has not been considered and disposed of although cost for such measurement of the land of the petitioner was also deposited. While the said matter is kept pending the respondent State are proceeding with construction of boundary wall on the adjoining land of the State for bounding the Keshariya police station. It has, thus, been submitted that the application be disposed of directing the respondent Circle Officer

to consider the application of the petitioner (Annexure-3) and dispose of the same in accordance with law as quickly as possible considering the fact that the respondents are constructing boundary wall on the adjacent Government land for construction of police station. The petitioner apprehends that in such construction of boundary wall the respondent State have encroached part/portion of the land claimed/owned by the petitioner.
Considering the submissions of the parties, this Court is satisfied that the present application be disposed of by the following order:-
Let the respondent Circle Officer, Keshariya consider and dispose of the application filed by the petitioner (Annexure-3) in accordance with law as quickly as possible preferably within three weeks from the date of receipt/production of a copy of this order before him.
