The writ petition has been filed for a limited relief. The petitioner a licensee under the Bihar Fair Price Shop Order, 2007 prays for disposal of the statutory appeal filed by him bearing Appeal (Supply) Case No. 13 of 2014 which remains pending before the District Magistrate-cum-Collector, Gaya, the respondent no. 2. The petitioner is a holder of license to run a shop under the Public Distribution System bearing License No. 129 of 2007. His license was cancelled under the order of the licensing authority-cum-Sub-Divisional Officer, Sadar, Sherghaty,

Gaya vide order passed on 07.06.2014 and being aggrieved he has preferred a statutory appeal bearing Appeal (Supply) Case No. 13

Taking note of the grievance of the petitioner, this writ petition is disposed of with the direction to the District Magistratecum-Collector, Gaya to consider and dispose of the appeal bearing Appeal (Supply) Case No. 13 of 2014 in accordance with law and after giving opportunity of hearing to the petitioner expeditiously and preferably within three months from the date of receipt / production of a copy of this order.
