Heard learned counsel for the petitioners as well as learned AC to G.P.11.
After hearing respective counsels, the sailing of proceeding before the learned Subordinate Court gives a pathetic picturization. Petitioners who happens to be one of the parties of Miscellaneous Case No.419 of 2007 pending before Sub Divisional Magistrate, East, Muzaffarpur has a grievance that since 2007 instant proceeding has not crossed the preliminary hurdle.
Virtually, it happens to be a matter of concern. Accordingly, the learned Lower Court is directed to proceed with the trial in accordance with law smoothly but without giving undue adjournment.
With the aforesaid observation, instant petition is disposed of.
