Learned counsel submits that from the F.I.R. itself it is apparent that the informant, who is the husband, apprehends that for the purposes of marriage the victim had been enticed away by the petitioner, Tanki and Naresh. Learned counsel submits that in the statement of the girl, who was found at the Railway Station, before the Court under Section 164 of the Code of Criminal Procedure, 1973 (hereinafter referred to as the ‘Code’) the story is that Naresh panicked and informed the mother of the girl and they came and took away her from the Railway Station. Learned counsel submits that in the F.I.R. which has been registered after 5 days of the alleged incident by the husband he states that in the morning his wife had been enticed away by the accused whereas in the statement before the Court the girl had stated that she along with her husband had gone for morning walk and the accused had taken the husband for having tea. Learned counsel submits that there is no allegation with regard to any abuse of the girl. Learned counsel submits that the petitioner has clean antecedent and is in custody since 19.12.2013.
