Learned counsel for the petitioner submits that though the allegations against him is of committing rape on the minor girl but as per the medical report, there is no sign of any rape. It is submitted that the petitioner is in custody since 20.01.2013.

Learned A.P.P., upon going through the case diary submits that the petitioner has been named both in the F.I.R. and also in the statement of the victim girl herself before the Court under Section 164 of the Code of Criminal Procedure, 1973, in which she has stated that the petitioner had tried to sexually assault her. that the medical report has found the girl to be minor and also signs of violence on her private part.

Considering the facts and circumstances of the case and submissions of learned counsels for the parties, this Court is not inclined to enlarge the petitioner on bail. The application stands dismissed. However, the Court below shall expedite the trial and conclude the same within nine months.
