The petitioner, apprehending his arrest in connection with Jamhore P.S. Case No.108 of 2013, registered for the offence under Sections 143,341,323, 307, 504 and 506 of the Indian Penal Code, has prayed for grant of anticipatory bail.

Learned counsel for the petitioner submits that the present case has been instituted as a counter blast to the case, which was registered as per instance of the petitioner’s side. He further submits that save and except the fact that petitioner is named as one of the accused, there is no specific accusation against the petitioner and, as such, it was submitted that it is a fit case for extending the privilege of anticipatory bail.

I have perused the material available on record. Since there is accusation regarding participation in the occurrence and

the petitioner is also named in the F.I.R., it is not a fit case for extending the privilege of anticipatory bail. However, if the petitioner surrenders before the court below and makes a prayer for regular bail, the court below without being prejudiced with this order may examine the same and pass appropriate order in accordance with law.

It was submitted by learned counsel for the petitioner that one of the accused having similar accusation has already been granted regular bail. The learned court below may consider the plea of the petitioner, while examining the regular bail petition.

Accordingly, the petition stands disposed of.
