4/ 11-08-2014 Heard learned counsel for the Petitioners, Opposite Party No.2, and the State.

The Petitioners seek quashing of the order dated 09.05.2011 passed by the Sub-Divisional Judicial Magistrate, Bettiah, West Champaran, in Trial No.596 of 2011 arising out of Nautan P.S. Case No.80 of 1987, by which the Trial Court has refused for further time to the defence for adducing defence witnesses.

Since the Petitioners undertake that they will produce all the five witnesses on three dates, if the case is fixed on day to day basis, the Trial Court is directed to fix the case for three
