The petitioner seeks bail in connection with Raxaul P. S. Case No. 128/2014 registered for the offence under section 414 of the Indian Penal Code.

Allegedly, acting on a tip off that three persons are standing alongwith two stolen motorcycles, the informant and other police personnel raided there, then persons trying to flee away but they were arrested and from their possession one motorcycle has been recovered without any paper.

Submission at the bar for release of the petitioner is that the petitioner is a Constable in Nepal Police (Vide Annexure-2), he has come to In-laws house and has been made victim of the circumstances. The petitioner is suffering in custody since

Learned APP opposes the prayer for bail by showing the alleged recovery.

In the facts and circumstances stated above, considering that the petitioner has got no criminal antecedent and considering his detention, the petitioner Chabbi Lal Yadav @ Chhabi Lal Raut Ahir is directed to be released on bail on execution of bail bond of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Raxaul (Hariya) P. S. Case No. 128/2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
