3 29-04-2014 Petitioner being husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 323, 379, 494, 498A of the I.P.C and ¾ of the Dowry Prohibition Act.

The accusations are of torture for nonfulfilment of dowry demand and performing second marriage.

The factum of marriage between the petitioner and the informant and birth of a female child are admitted facts. Though a decree for judicial separation for one year has been passed in Matrimonial Case No. 60 of 2010 on 20^th of May, 2011.

The petitioner is ready to keep the informant and the child with full dignity and honour. The offer is acceptable to the informant who is present in the Court, in spite of the fact that petitioner has performed second marriage.

a period of ten days.

Considering the present stand of the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for six months, on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Warisaliganj P.S. Case No. 14 of 2013.

The provisional anticipatory bail of the petitioner will be confirmed by the learned Court below on substantial restoration of the matrimonial harmony within a period of six months, or if the matter could not be reconciled due to the fault of the informant. But, the provisional bail of the petitioner will not be confirmed by learned Court below, if the issue could not be reconciled due to the fault of the petitioner.
