Mother had made allegation against her son, daughter-in-law, grand daughter, grand son along with others who have assaulted and ousted her from house when she inquired about Rs.7,50,000/- which was handed over to petitioner to deposit the same in her bank account.

It has been submitted on behalf of petitioner that all the allegations happens to be false and frivolous. Same has purposely been levelled on account of Complaint Case No.19(c) of 2010 filed by one of the accused Yasmin Khatoon, wife of petitioner wherein informant had obtained anticipatory bail and on account thereof had appeared before the learned lower court on 20-02-2014 and is facing trial. Therefore, it happens to be un-trustable to accept that in the background of strain relationship informant will handover Rs.7,50,000/- to the petitioner. Also submitted that petitioner happens to be under custody since 11.04.2014.

The learned Additional Public Prosecutor opposed the prayer and submitted that the allegation is of criminal breach of trust.

Considering the nature of allegation in consonance with the period of detention coupled with inter-se relationship petitioner Md. Naseem is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P.S. Case No.345 of 2013.
