2 01-09-2014 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 498(A) of the IPC and Section 3/4 of the D.P. Act registered in connection with Alamganj P.S. Case No. 325 of 2013.

It is submitted that the petitioner has been falsely implicated as the very fact of marriage is denied and for

which a Complaint Case No. 2558 (C) of 2013 (latter converted into FIR) and also Matrimonial Case No. 596 of 2013 for declaring the alleged marriage null and void filed by the petitioner well before the present FIR.

Learned counsel for the informant appears suo motu and opposes the anticipatory bail petition stating that in fact the parties had chosen to solemnize marriage on 15.06.2013 itself which was even prior to the petitioner’s Complaint and Matrimonial Case.

Having regard to the entirety of the facts and circumstances of the case, as such, in the event of the petitioner’s arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M., Patna City, Patna, in connection with Alamganj P.S. Case No. 325 of 2013, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
