JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 3 07-04-2014 Heard learned counsel for the petitioner and the learned A.P.P. for the State. The petitioner is accused in connection with Sultanganj P.S. Case No. 84 of 2013 registered under Sections 498(A) and 302 of the Indian Penal Code.
The accusation is that the petitioner caused injury to his wife, Rinku Devi, sister of informant, Pawan Prasad, due to quarrel, who died on reaching at P.M.C.H, Patna, in the emergency ward. It would appear from paragraphs 7 and 22 of the case diary that mother and son of petitioner, have also stated about causing injury by the petitioner to his wife, Rinku Devi.
Taking into consideration the facts and circumstances of the case and the nature of allegation, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected. However, the trial court is directed to expedite the trial.
