	The Petitioner seeks quashing of the order of
	cognizance dated 28.8.2010 passed by the Chief Judicial
	Magistrate, Buxar, in connection with Complaint Case No.8(0) of 2010.

It has been submitted that the order of cognizance dated 28.8.2010 passed by the Chief Judicial Magistrate, Buxar, in Complaint Case No. 8(0) of 2010 is not justified since the investigation of First Information Report of Buxar P.S. Case No. 25 of 2010 dated 16.4.2010 for the same cause of action is continuing.

Considering that at least the present Complaint has been brought to its logical end, I am not inclined to quash the

order of cognizance on this ground.

However, the application is disposed off with a direction to the Investigating Officer to conclude the investigation positively within a period of three months from the date of receipt of this order and also consider the facts of the Complaint Case No. 8(0) of 2010 and if he finds that both the cases arise out of the same transaction and also as against the same accused persons, an application shall be given by him to the Court concerned for amalgamation of both the cases.
