3 07-07-2014 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in Runnisaidpur P.S. Case No. 218 of 2013 dated 05.07.2013 instituted under Sections 323/363/366A/376/498A/120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the F.I.R. has been lodged on the basis of a complaint case filed on 26.06.2013. It is submitted that the petitioner’s family and the informant’s family are agnates. Learned counsel submits that the

allegation is that the petitioner along with his other family members abducted the daughter of the informant and sold her to one Bablu Sahani who is said to have forcibly married the daughter and lateron there is allegation of demand of dowry. Learned counsel submits that the F.I.R. itself discloses that the incident is of two months prior to the date of complaint for which there is no convincing reason. Learned counsel submits that in fact the wife of the petitioner had filed a complaint case under Sections 395 of the Indian Penal Code and 25/26 of the Arms Act a month prior to the informant of the present case filing the complaint case. It is submitted that the petitioner has clean antecedent and the girl has also since returned without there being any medical examination.

Considering the facts and circumstances of the case and submissions of learned counsels for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in Runnisaidpur P.S. Case No. 218 of 2013.
